(1) The petitioner, Steven D. Humes, seeks to invoke this Courts original jurisdiction to issue an extraordinary writ of mandamus to direct the Superior Court to deny the motion of the State of Delaware to vacate the dismissal of a criminal charge against Humes and, also, to direct the Attorney General to investigate the victim of the criminal charge. The State of Delaware has filed an answer requesting that Humes petition be dismissed. We find that Humes petition manifestly fails to invoke the original jurisdiction of this Court. Accordingly, the petition must be dismissed.
